- Last Will and Testament of Christian Campbell Smith
January 11, 1877
I, Christian Smith of the County of Richmond and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make this my last will and testament in manner and form following, that is to say. First that my executor (hereafter) named shall provide for my body a decent burial suitable to the wishes of my relatives and friends. And pay all my funeral expenses together with my just debts however and to whomsoever owing out of the money that may first come into his hands as part and parcel of my estate. And I give and devise to my beloved grandson, William Prince Wilks the sum of one dollar. And I give and devise to my beloved grandson Daniel Malloy Wilks, the sum of one dollar. And I give and devise to my beloved stept son John M. Smith of the State of Georgia and County of Marion one shot-gun known as the hunting gun of Abijah Smith in his lifetime. And I further give and devise to my sister Margaret Watson one third part of my remaining property both real and personal or in case of her death to her heirs at law. I give and devise to my half-brother George W. McKinnon one third part of my property both real and personal or in case of his death to his heirs at law. I give and devise to my half-sister Sarah Waters one third part of my property both real and personal in case of her death she having no heirs of her own body. Then her third part to be equally divided between the above named Margaret Watson and George W. McKinnon or their heirs at law. And lastly, I do hereby constitute and appoint my trusty friend and half brother George W. McKinnon my lawful executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof hereby revoking and declaring utterly void all other will hereto fore made in witness whereof I the said Christian Smith do here unto set my hand and seal this January 11 A.D. 1877. Witnessed by A.R. McDonald and John A. McDonald. Probated December 31, 1883 WB-6/266
