    Geneper Hall's Will

    State of Georgia I, Geneper Hall of the State and County aforesaid, being of sound mind and memory, but knowing it is appointed for all men once to die, do make and ordain this my last will and testament, that is to say, first of all I give my soul into the hands of Almighty God who gave it to me, and my body to the grave to be buried in a decent Christian like manner. Impressive my will and desire is that all my just debts be paid and fully discharged.

    Item: I lend to my wife Martha during her natural life my negro woman called Dinah and her increase.
    Item: I give an bequeath to my wife Martha and sons to wit, John, Travis, Bowling, Cyrus, Daniel Green and Lyman Hall all the land and crops I own in Emanuel County, also all my stock of horses, hogs, cattle and geese except as herein after excepted. Also all my household and kitchen furniture except one good feather bed. Also all my farming utensils of every description. But if my wife Martha should remarry she shall have only a child's part of this property.

    Item: I give and bequeath to my daughter Edaline my negro girl called Jane and her increase at her marriage or when she shall arrive at twenty one years of age.

    Item: I give to my sons above named my two negro boys called Abraham and Brimos to them and their heirs forever.

    Item: My will and desire is that Dinah the woman that I left but to my wife, after her death, returns to my sons aforesaid to them and their heirs forever.

    Item: My will and desire is that if my daughter Edaline should die without a lawful heir of her body that my negro girl Jane and her increase be given to my sons aforesaid to them and their heirs forever.

    Item: My will and desire is that all of the above mentioned negroes, except Jane be kept on the plantation together, until my son Lyman arrives at the age of fifteen years for the supporting and educating of my children aforesaid, and that they then be equally divided among them, but Dinah only to pass on the death of my wife Martha and Jane also to remain for the purpose aforesaid until taken away as directed.

    Item: I give and bequeath to my son Patrick the colt that belongs to my man Harlot, two likely young cows and calves, one good feather bed, and my negro boy called Sam and a tract of land I drew in my own name in the third district of Early Countyy}, to him and his heirs forever.

    Item: I give and bequeath to my son James my negro boy called Adam to him and his heirs forever.

    Item: I give and bequeath to my son Robert, Lot No. 286 in the 6th district of Early County to him and his heirs forever.

    Item: I give and bequeath to my daughter Nancy my negro girl called Liller to her and her heirs forever.

    Item: I give and bequeath to my son Geneper {Jr}my negro girl called Riner to him and his heirs forever.

    Item: I give and bequeath to my daughter Elizabeth my negro girl called Piggy to her and her heirs forever.

    Item: My will and desire is that my negroes Liller, Adam and Riner be appraised by disinterested persons immediately after my decease and their appraised value be divided into eight equal parts or shares and when said negroes shall be viewed by the said Geneper {Jr}, James and Nancy or their representatives, they shall give their notes to my executors for five eighths of their whole appraised valve, each giving his or her notes in proportion to the value of his or her negro, notes made payable within twelve months after my decease, and when said money is collected my executors must pay Thomas Hall forty dollars out of it after all demands against he estate are settled out of the balance and what debts are due the estate that can be collected…the balance, if any, must be paid equally to William, Kindred, Thomas, Robert Hall and Mary Darcey.

    Item: I give and bequeath to my sons James and Thomas Lot No. 412 in the twenty first district of Early County, to them and their heirs forever. And last I do hereby nominate, constitute and appoint my friend John Love and my dear wife Martha Hall executors of this my last will and testament by me made and allowing notifying and confirming this and only this to be my last will and testament. I testimony whereof I have hereunto set my hand and seal this twenty first day of August in the year of our Lord, eighteen hundred and twenty seven.

    Georgia, Emanuel County Personally came into the Honorable in the Inferior Court setting for Ordinary purposes Daniel Green and Samuel Green who being duly sworn on the Holy Evangalist deposeth and said that they saw Geneper Hall Sr. sign, seal, acknowledge, publish and declare the foregoing to be his last will and testament and that he, the said Geneper Hall Sr., did ordain and appoint John Love and Martha Hall, his wife, to be his true and lawful executor and executrix to his said last will and testament, and that the said deponents did assign the same as subscribing witnesses at the request of said deceased and also saw Rueben Martin assign the same as subscribing witness.

    *Notes:
    (1) Geneper is the correct spelling, since in the original will, the same cursive letter used for Georgia is definitely the same used to spell Geneper.
    (2) Martha Hall is his wife at the time of his death, Martha Thigpen Hall, daughter of Travis Thigpen and Hannah Hardy-Hall Thigpen
    (3) There are seventeen individuals, other than wife Martha, given shares of the estate, i.e. John, Travis, Bowling, Cyrus, Daniel Green, Lyman, Edaline, Patrick, Robert, James, Nancy, Elizabeth, Geneper {Jr}, Thomas, Kindred, William Hall and Mary Darcey. Most, but not all, are referred to as son or daughter directly, but they share the estate as such. The first seven children are definitely Geneper and Martha’s. The 1820 and subsequent Emanuel County censuses supports this theory. The remaining children mentioned would have been from a previous marriage or marriages in Montgomery or Washington counties in Georgia or even in North or South Carolina.
    (4) Co-executors are John Love and wife Martha Hall.
    (5) Witnesses are Daniel Green, Samuel Green and Rueben Martin. The Green family could be in-laws since a son was named Daniel Green Hall
    (6) There is support for the first wife of Geneper being a Braswell, since a family of this name lived close by with given names of Kindred, Robert, Nancy, Elizabeth and Thomas Braswell.
